Terms and Conditions of sale

General sales provisions

Subject to Legislative Decree no. 206 of 2005 – Consumer Code, as reformed by Legislative Decree 21 February 2014, n. 21 for contracts concluded between consumers and professionals after the date of 13 June 2014 and subsequent amendments. Any invoice request must be made before the order and/or payment. Invoices requested for subsequent dates will NOT be issued.

Characteristics of the goods/services and acceptance of the conditions of sale

The products and services for sale are digital, online courses based on text and audiovisuals without material supports, with a service contract, which is completed by sending the credentials via email to access and use the items ordered online within the terms advertised in the single courses, typically 3, 6 or 12 months maximum. The purchase of online courses can only be done through the website https://www.smartkids.school/ 

By placing an order online, the customer declares to have read all the information provided to him during the purchase procedure and to fully accept the general payment and shipping conditions set out below as well as the specific ones available in each product sheet. With the acceptance, even if only partial, of the order, the contract between the IWEB seller and the customer is perfected, or, directly, between the customer and the supplier/partner where specified.

When submitting the order, you will be expressly indicated that the order implies the obligation to pay. In each product or service sheet, the commercial partner who will provide the service and/or who will take care of the course management activity will be indicated, against which the Consumer can exercise the rights provided for by art. 130 of the Consumer Code (restoration or replacement in case of non-conformity of the product). In the absence of an indication of the partner, these rights will be exercised towards IWEB. There are no transport or delivery costs as they are online products.

The language available to conclude the contract is Italian.

Information relating to the Products and Price

Prices

All prices shown on the site include VAT. Since they are ebook cards and online courses, there are no shipping costs. Any price changes and promotions may take place without notice, but in any case, the orders will be processed with the price indicated at the time of purchase. The order is confirmed with payment, which must be made within 7 days.

Availability of products

In the IWEB policy, it is possible to purchase only readily available products. The purchased product will be delivered to you within a maximum of 30 days from the order. The services will be provided within the deadline foreseen in each offer or will be agreed upon between the consumer and the service provider.

Order via website 

The purchase of goods and services can only be made through the website https://www.smartkids.school/  It is possible to purchase with an electronic shopping cart only the products present in the online catalog of the site at the time the order is placed, as described in the relevant information sheets. The images of the products visible on each product sheet are indicative. To purchase, simply add the desired products to the cart (by clicking on the appropriate button) and follow the instructions on the screen. At the end of the order, an order summary e-mail will be automatically sent with all the details relating to the purchase.

Methods of payment 

On the site SmartKids.School you can choose between different payment methods, all are guaranteed according to the most modern security standards, by their respective managers.

Payment by credit card

To guarantee maximum security in payments, the online transactions of your purchases paid for by credit card are made through PayPal or Stripe, through a secure server that adopts the latest protection. This system takes care of encrypting the information entered, so as to make it impossible to intercept them. Your credit card details are not retained by us but managed by Stripe to carry out the transaction, offering you the maximum guarantee. Unlike what happens in a traditional business, online transaction becomes absolutely safe because no one (not even us) can get to know the codes of the credit cards used by its customers.

If the payment is successful, the confirmation is immediate. We only receive a transaction number from Stripe. No trace of the credit card code remains in any of our archives. In order to avoid the unauthorized use of other people’s cards, IWEB reserves the right to ask the Customer for additional information or to send copies of documents proving ownership of the card used. In the absence of the required documentation, we reserve the right not to accept the order.

Payment by bank transfer If you prefer you can pay your order with a bank transfer to the bank details that will be indicated to you when ordering and after sending the order by email. Remember that the credentials for digital services will be kept engaged until the receipt of the proof of the transfer (paper receipt or confirmation of the online transfer) which you must send us by e-mail by replying to the order email no later than 7 days from the date of order acceptance. The purpose of the bank transfer/bulletin must include the order number and surname of the order holder. Any costs incurred to make the bank transfer or PostePay recharge are charged to the customer.

Confirmation of receipt of order

In compliance with the provisions of art. 53 of the Consumer Code, the Customer receives, at the time of the execution of the contract, by email, the confirmation of receipt of the purchase order sent by the Customer, containing a summary of the General Conditions, the essential characteristics of the ordered product, its price, the amount paid, the existence of the right of withdrawal – with an indication of the times and methods – of the geographical address to submit any complaints and information on the assistance services and on existing commercial guarantees.

This confirmation message will contain the date and time of execution of the order and a ‘Customer Order Number’, to be used in any further communication with IWEB. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.

In case of non-acceptance of the order, IWEB guarantees timely communication to the Customer

Ineffectiveness of the order

No contract must be considered concluded between IWEB and the Customer if IWEB has reasonable grounds to believe that the Customer does not operate on the basis of an effective and genuine interest in purchasing the products ordered, or abuses the right of withdrawal recognized by art .12 that follows.

In such cases, the order sent by the Customer must be considered ineffective. IWEB will send to the Customer, by e-mail, a communication certifying the non-conclusion of the Contract, also taking care of the cancellation of any charge and/or expense charged to the Customer.

Transport and Delivery 

There are no transport or delivery costs as this is a service contract that is completed by sending the credentials via email to access and use the order online.

Right of withdrawal, Warranty, Refunds, Security, and liability 

The courses will be delivered through specific sites belonging to IWEB or commercial partners, communicated in the activation email, and will remain active for the period indicated in the product sheet. The specifically indicated service provider is the party responsible to the consumer for compliance, safety, and in general the content and quality of the service. The purchase of the service on the site includes the sending of the credentials received by the provider to the student, technical assistance in order to use the course correctly, and in case of technical difficulties. The student is required to fill in and send any forms requested by the provider directly to his / her references indicated on these documents. 

Right of withdrawal

IWEB makes the transparency and safety of the customer one of its strong points in compliance with current legal provisions. Dedicated customer service will be at your disposal for any request and/or problem ready to solve everything. There is no right of withdrawal for the Online courses consisting of PDF and audiovisual files, while not falling within the cases contemplated by the law for withdrawal, we also offer the possibility to withdraw from the contract within 3 (three) days without penalties, excluding any fees/costs for payment, which are non-refundable. The withdrawal period expires after 3 days from the activation.

To exercise the right of withdrawal, you are required to inform us of your decision to withdraw from the contract through an explicit declaration by replying to the order or activation email, or via PEC informaweb@pec.it, communicating your bank details to make the refund.

Effects of withdrawal 

Within 7 days from the day we were informed of the withdrawal, we will deactivate the course and proceed with the refund by bank transfer. The refund refers to the full price paid excluding transaction fees. There are no transport costs or return costs as this is an online service contract that will be immediately terminated. The law applies to the product in its entirety; it is therefore not possible to exercise the withdrawal only on part of it.

Exclusion of withdrawal

The right of withdrawal described above does not apply in the following cases:

a) service contracts after the complete provision of the service if the execution has started with the express agreement of the consumer and with the acceptance of the loss of the right of withdrawal following the full execution of the contract by the professional;

b) the supply of digital content through non-material support if the execution began with the express agreement of the consumer and with his acceptance of the fact that in this case, he would have lost the right of withdrawal.

c) In courses that require the release of the Skills Card upon explicit request of the customer within the terms established by the activation email, the completion of the online Skills Card request form indicates the customer’s willingness to continue with the course, therefore invalidating the right of withdrawal.

Warranty, after-sales assistance, and contract duration 

Since the products treated on this site are not material goods, but service contracts, if these do not comply with what the customer has requested, withdrawal is possible within the terms indicated above. Unless otherwise specified, the courses are available for 12 months from payment, with assistance service for any anomalies throughout the contract period. At 12 months, the contract ends and it is no longer possible to access the contents, if interested in continuing to use it, it is possible to request a new contract on favorable terms, see offers.

B2C customer purchase documents and invoice requests for B2B customers 

According to the current legislation which provides for particular simplifications for those who carry out the E-Commerce activity, there is no obligation to issue receipts or other, when sales are made to final consumers (B2c). For B2B customers with a VAT number, it is necessary to indicate the data for electronic invoicing when ordering. It is not possible to request an invoice later.

Refunds 

Refund will be made by bank transfer to the bank account in the name of the person who made the payment, net of transaction costs, or via Paypal.

Safety and responsibility

IWEB will not be held responsible for any direct or indirect damage deriving from improper or non-compliant use of the products sold. It is recommended to carefully read the warnings and instructions on the screen and in the emails sent. The products marketed comply with the standards and are approved according to the European Community regulations.

Applicable law and competent court

These General Conditions are governed by Italian law and must be interpreted in accordance with Italian law. For disputes arising from the interpretation, validity, and/or execution of these General Conditions, the mandatory territorial jurisdiction will be that of the court of Catania.
